Terms and conditions
1.1 The 2019 edition of the “Oasis® 1st day at school!” program (the “Program”) is open to residents of Canada only. To be eligible to register to the Program, a participant must (i) be a natural person, (ii) be a legal resident in his or her province or territory, (iii) have reached the age of majority in his/her province/territory of residence at the time of registration in the Program and (iv) be the parent of a child or children (a “Child” or “Children”) enrolled in first (1st) grade of elementary school during 2019-2020’s school year (a “Participant”, collectively the “Participants”).
1.2 Participants who are parents of children too young to be enrolled in first (1st) grade of elementary school during 2019-2020’s school year can register to the Program nonetheless, but will not receive a Starter Kit (as defined below) for the upcoming 2019-2020 school year. The Sponsor will take reasonable measures to contact such Participants once their children are old enough to be enrolled in first (1st) grade of elementary school, if the Program still exists at that time. The Sponsor shall bear no responsibility if unable to contact such Participants in anticipation of a Child’s first time in first (1st) grade in elementary school.
1.3 The Sponsor makes no representation or warranty with respect to the duration of the Program.
2.1 The Program is sponsored by A. Lassonde Inc. (the “Sponsor”). Participants who wish to receive a Starter Kit (as defined below) for the upcoming 2019-2020 school year have to register to the Program in accordance with section 3 before July 6th, 2019 at 11:59:59 p.m. (EDT) (the “Deadline”).
3.1No purchase is necessary. To register to the Program, a Participant must go to the Program’s website at the following address 1stdayatschool.ca (the “Program Site”) in order to (i) create an account by submitting all information requested to do so and fill all the designated fields accordingly (an “Account”, collectively the “Accounts”) and (ii) register his/her Child by submitting all information requested to do so and fill all the designated fields accordingly (a “Registration”, collectively the “Registrations”).
3.2 Among the information requested to complete a Registration, a proof that a Child is enrolled in first (1st) grade of elementary school during 2019-2020’s school year must be submitted (a “Proof”, collectively the “Proofs”). Valid Proofs can vary in form, but must contain at least the following elements: (i) the full name of the Child and (ii) a mention that the Child is enrolled in first (1st) grade of elementary school during 2019-2020’s school year. Here are some examples of valid Proofs (if they contain the required information as per this paragraph): school supplies list, email or letter from school, etc. If the Proof chosen by a Participant to complete a Registration contains personal information or other sensitive information that is not required in a Proof under this paragraph, such Participant shall black it out or make such information unreadable. The Sponsor has the entire discretion to determine whether a Proof is valid or not. Participants who do not have such Proof when completing a Registration can still register their Child, as long as they upload a valid Proof before the Deadline. Failure to do so will render all such Registration ineligible and void.
All of the fields must be completed in order to create an Account or Registration, unless the information is indicated as being optional or can be given later on. Any Account or Registration for which the required information is incomplete or inaccurate will be declared ineligible to the Program and deemed void. The Sponsor reserve the right to request proof of identity or of eligibility to the Program at any time and at its sole discretion.
3.4 A Child can only be registered once to the Program. Participants can register more than one (1) Child to the Program.
3.5 Automated entries are prohibited, and any use, whether direct or indirect, of automated devices will cause immediate disqualification of the Participant and its accomplices, and the Sponsor reserve all of its rights and recourses against the user of such automated devices and its accomplices.
3.6 The Sponsor suggests that Participants who do not have Internet access inquire with public libraries or visit any other public space providing free internet in order to enter the Program in the manner set forth in this section 3.
3.7 The Sponsor may modify the registration process to the Program from time to time.
4.1 For each valid Registration, Participants will receive one (1) starter kit for their Child’s first day in school, each including:
(a “Starter Kit”, collectively the “Starter Kits”).
4.2 A maximum of twenty-five thousand (25,000) Starter Kits will be awarded during the Program.
4.3 The Sponsor will take all reasonable measures to deliver the Starter Kits to the Participants by mail before the Children’s first day of school or shortly thereafter. Starter Kits will be delivered to the postal addresses available on the Accounts. The Sponsor is not be responsible for Starter Kits not delivered to Participants’ addresses because of inaccurate or incomplete information available on the Accounts. In the event a Starter Kit cannot be delivered to a Participant and/or is returned to the Sponsor, such Participant’s Account may be cancelled and such Participant may be removed from the Program as a result, at the Sponsor’s entire discretion.
4.4 The Sponsor may also, from time to time, provide the Participants with other offers, such as, without limiting the generality of the foregoing and without any representation or warranty by the Sponsor with respect to the quantity, quality or existence of such offers: promotions, coupons, product samples, etc. (the “Offers”). The Offers, if any, will be provided to Participants through either mail or email if the Participants have agreed to receive such communications when registering to the Program. Such consent may be withdrawn at any time.
4.5 Participants are responsible for all taxes and other charges imposed by any government or other entities with respect to Starter Kits and Offers.
5.1 By entering the Program, each Participant consents to the collection, use and disclosure by the Sponsor or its authorized agents of the Participant’s and Child’s personal information provided through the Account and Registration (the “Personal Information”) for the purpose of carrying out the Program and delivering the Starter Kits and Offers only. Once created/submitted, the Accounts and Registrations become the exclusive property of the Sponsor and will not be returned.
5.2 The Personal Information may be transferred to third parties that are retained by the Sponsor to perform storage, management and other similar functions, subject to the laws applicable to the protection of personal information and the Sponsor’s internal policies regarding personal information. Files containing Personal Information will be kept at the Sponsor’s or its service provider’s offices or on their servers, and employees who require access to the Personal Information in order to fulfil their job duties will have access to these files. To the extent provided by applicable law, the individuals concerned may request access to the file containing their Personal Information and the correction of such information by contacting the Sponsor c/o Marketing Department of A. Lassonde Inc. at 170, 5th avenue, Rougemont (Québec) J0L 1M0.
5.4 The Personal Information will be kept for the duration of the purposes for which they have been collected for and will be destroyed within a reasonable period of time once these purposes have been fulfilled.
6.1 Participants agree to be bound by the terms and conditions of this Program (the “Terms and Conditions”) and by any decisions made by the Sponsor in relation with the Program. The Sponsor reserve the rights, at its sole discretion, to disqualify and exclude from the Program (or any other promotion, contest or offers the Sponsor may have from time to time) any individual who contravenes or attempts to contravene these Terms and Conditions.
6.2 Accounts cannot be transferred and shall enure to the benefit of the individual that created it only.
6.3 Each Starter Kit and Offer must be accepted as is, cannot be transferred and is without substitution in cash or otherwise. The Sponsor reserve the right at its entire discretion to substitute a good/service of equivalent value if a Starter Kit or Offer cannot be awarded as provided for by these Terms and Conditions. Any Starter Kit or Offer or portion thereof that is not accepted or used by a Winner will be deemed forfeited or null and the Sponsor won’t bear any responsibility. The Starter Kits or Offers cannot be exchanged, transferred or substituted for cash. The Sponsor do not warrant, either implicitly or expressly, the safety, appearance or performance of the Starter Kits or Offers or any activity related to the Starter Kits or Offers. Each Participant does not have any recourse against the Sponsor for any warranty related to the Starter Kits or Offers in any circumstance whatsoever. The Sponsor shall assume no responsibility of any nature whatsoever for any event leading to the cancellation of the Starter Kits or Offers or any of their component or leading the Starter Kits or Offers or any of their component not to be awarded, for any reason whatsoever.
6.4 The Sponsor reserve the right, at its sole discretion, to exclude from the Program and any other contest, promotion or offers organized by the Sponsor, any person guilty or suspected of being guilty of having tampered with the treatment of the Accounts, Registrations, the Program’s process or the Program Site, of having violated these Terms and Conditions or having acted in a disloyal manner or in a manner which adversely affects or is intended to disturb, abuse, threaten or harass another person. a participant or any other person who attempts to deliberately damage the Program site or any other website or hinder the legitimacy of the Program process commits criminal and civil OFFENCES and the Sponsor reserve the right, in such case, to CLAIM DAMAGES TO THE EXTENT PERMITTED BY LAW.
6.5 In the case of a discrepancy between the French version and the English version of these Terms and Conditions, the French version will take precedence.
7.1 The Sponsor reserve the right to cancel any Account or Registration containing errors. Accounts or Registrations which have been tampered with or have been deteriorated, modified, falsified, reproduced or obtained illegally will not be eligible and deemed null. The Sponsor and any organization participating in the management of the Program or in the supply of the Starter Kits or Offers and their respective administrators, directors, employees, shareholders, agents and other representatives, parent-company and affiliates, will not be responsible: (i) for Accounts or Registrations that are ineligible, incomplete, modified, lost or delivered late, which Account/Registration shall be deemed null, (ii) for any information which is insufficient or incorrect related to the Participants or of the equipment or program used in the context of the Program, or of a technical or human error which could occur when the Accounts or Registrations are being processed; (iii) for Accounts and Registrations that are stolen, destroyed, tempered with, accessed without authorization or altered; (iv) for problems or technical malfunction related to networks, telephone lines, online computer systems, servers or access providers, computer equipment and software, viruses or bugs; (v) for the Sponsor not being able to receive or send an electronic message or email, for any reason whatsoever, including traffic congestion on the internet or on any website or both; (vi) for damage caused to the Participant’s or another person’s computer system or equipment as a result of participating in, uploading or downloading material in relation to the Program.
7.2 The Sponsor may change as well as partially or completely terminate or cancel the Program, the Starter Kits or Offers at any time if, at its sole discretion, the Sponsor believes that the Program is not taking place as expected for any reason whatsoever, including, without limiting the generality of the foregoing, because of fraudulent manipulation, destruction, loss or theft of the Accounts or Registration or because of any other problem which could jeopardize or corrupt the integrity, conduct or security of the Program.
7.3 By entering or attempting to enter the Program, each Participant or potential participant agrees:
8.1 All intellectual property covering the promotional material and the Program are the exclusively property of the Sponsor or its affiliates or licensors. All rights are reserved. Unauthorized copyright or use of any copyright material or intellectual property without the express written consent of its owner or holder is strictly prohibited. All trademarks are the property of their respective owners.
9.1 These are the official Terms and Conditions for the Program. The Program is subject to all applicable federal, provincial and municipal laws and regulations in Canada. These Terms and Conditions may be modified without notice including without limitation in order to render them compliant with federal, provincial or municipal laws or with the policies of an entity having jurisdiction over the Sponsor.
Individuals entering in the Program acknowledge having read and accepted these TERMS AND CONDITIONS and agree to comply with them.
